Appeals Process
Reasons for appeal:
- An appeal process is available to organizations that believe they did not receive the Salary Reserve funds to which they are entitled. Though they are rare, there may be instances of a miscalculation on an eligible contract, or whose contracts that are mistakenly excluded from the Salary Reserve distribution, or situations where an amount received do not match a provider’s own calculations.
Timeline for appeals:
- The appeals period for the 2009 Salary Reserve distribution process will open on January 20, 2009.
- The deadline for receipt of provider appeals is February 6, 2009. Providers are encouraged to submit their appeals as soon as possible in order to expedite the review process.
- To submit at appeal, providers must follow the procedure outline below. EOHHS will review all appeals after February 6. EOHHS will notify providers regarding the outcome of its review of their appeal as soon as possible after February 6. In cases where EOHHS determines that the appeal is valid, an amendment to the provider’s Salary Reserve contract will be made.
Procedures for appeals:
- Providers wishing to appeal their Salary Reserve allocation need to do so by submitting the Appeal Form below.
- The appeal form may be completed and submitted electronically (via e-mail) to pos.salary.reserve@state.ma.us
- EOHHS will collect and review all appeals and will determine whether a correction is merited to any Salary Reserve allocation.
- Amendments will be prepared, send out to providers for signatures and processed for payment.
- Please do not return a signed contract if you are submitting an appeal. The POS Policy Office will notify appealing organizations regarding the outcome of the appeal and direct organizations to either submit the original contract or will issue a revised contract for processing.

December 31, 2008 Update – Provider Allocation Summary
EOHHS has posted the reserve allocations for all providers who applied for FY09 Salary Reserve funds. Contracts will be emailed to providers during the week of January 5th, 2009.
Fiscal Year 2009 Salary Reserve: December Update
Governor Patrick has approved the release of the $23,000,000 Salary Reserve for Fiscal Year 2009.
EOHHS appreciates the patience of the provider community over the last several weeks. We understand that the delay was difficult for many, but the additional time was necessary in order to fully confirm the FY09 and FY10 budget situation before moving forward.
Supporting the wages of human service workers is a priority for the Administration and an acknowledgement of the very difficult and important work that these individuals perform every day. They are a vital part of the community services provided by the state.
Due to fiscal constraints, the fiscal year 2009 Salary Reserve will not be annualized into the FY10 maintenance budget. For this reason, the allocation to eligible workers will be provided under a one-time compensation adjustment or, “bonus” structure rather than as a salary increase. Providers will be given special guidance in their Salary Reserve contract regarding the administration of the reserve in accordance with this provision. Additionally, providers should refer to the 2009 Salary Reserve guidance posted on this website as well as to the standard Salary Reserve Policies and Procedures and Frequently Asked Questions for additional assistance.
Based on payroll information submitted by providers in October 2008, the fiscal year 2009 Salary Reserve will support a bonus equal to up to 2.57% of eligible workers’ 2009 compensation. Because of staff turnover or personnel changes that occurred after the submission of payroll information, the exact percentage compensation adjustment that each provider organization shall grant to eligible workers may vary slightly from this 2.57% calculation. Each provider organization shall, however, grant a compensation adjustment of equal percentage across all eligible workers.
The Notice to Providers on Salary Reserve FY09 Allocation Amounts should be Posted by Wednesday, December 31st on this website.

Fiscal Year 2009 Salary Reserve – November 14, 2008 Update:
Thank you for submitting the FY2009 Salary Reserve Data through the Virtual Gateway PDM system.
As planned, the provider data was pulled from the PDM and submitted to EOHHS for review and, consecutively, to the EOHHS Agencies.
We are working on final calculations and expect to be delayed by at least one week. We're working on this diligently and will post an updated timeline on this salary reserve web page as soon as possible.

Fiscal Year 2009 Salary Reserve – October 2, 2008 Update:

The DEADLINE to enter and submit FY2009 Salary Reserve Data on PDM is Wednesday, October 08, 2008.
The Executive Office of Health and Human Services has extended the deadline for submission of FY09 Salary Reserve payroll information. The revised deadline for submission is Wednesday, October 8th at 6pm.
All data must be submitted through the Virtual Gateway (VG) PDM system by this time in order to be considered for FY09 Salary Reserve Distribution.

The EOHHS Virtual Gateway Provider Data Management (PDM) Salary Reserve line is now open to eligible purchase of service providers (POS) that wish to apply for FY2009 Salary Reserve Funds.
The deadlinefor providers to submit on PDM all payroll and salary information required for allocation of the FY09 Salary Reserve funds is October 3, 2008. Applications cannot be accepted after this date.
The FY2009 PDM Salary Reserve release enables POS providers to submit payroll information, such as FTE counts, annual salaries, and other data required to support the allocation of the Salary Reserve on the internet-based EOHHS Virtual Gateway.

August 25, 2008 Update – Fiscal Year 2009 Salary Reserve
The State Fiscal Year 2009 Budget contains Salary Reserve line item number 1599-6901 (Word).
EOHHS is charged with the task of managing and distributing the salary reserve in an accurate and timely manner. To facilitate collection of FY09 contract data, EOHHS will again be utilizing the Provider Data Management (PDM) service. PDM is an EOHHS Virtual Gateway business service that is available through the internet to Purchase of Service (POS) providers and EOHHS state agencies.
As of Wednesday, September 11, 2008, the PDM Salary Reserve release will enable POS providers to submit payroll information, such as FTE counts, annual salaries, and other data required to support the allocation of the Salary Reserve through the internet-based EOHHS Virtual Gateway available at https://gateway.hhs.state.ma.us/authn/index.jsp
In order to use PDM to submit Salary Reserve payroll information, all providers must have active accounts on the Virtual Gateway with user name and password access to the PDM Salary Reserve service. EOHHS Virtual Gateway has emailed information to providers regarding actions they must take in order to verify, update or activate an account on the Virtual Gateway. Providers want to make sure that their organization’s information with the PDM system is up to date. Once the required data is submitted by providers, EOHHS agencies will verify the accuracy of the information submitted, and EOHHS will calculate the salary reserve allocation for eligible employees.

Important FY09 Salary Reserve Milestones:
The first Salary Reserve payments are designed to occur by December 19, 2008.
In order to meet this timeline and be eligible for Salary Reserve funds, it is critical that providers adhere to the timeline outlined below.
- September 11 – October 3, 2008: Provider payroll data submission period.
- On Wednesday, September 11, 2008, PDM opens to Providers on the Virtual Gateway for on-line submission of salary reserve-eligible payroll information.
- The deadline is October 3, 2008, for providers to submit on PDM all payroll and salary information required for allocation of the FY07 Salary Reserve funds. Applications cannot be accepted for the FY09 Salary Reserve after this date.
- November 12 , 2008: Individual provider allocation amounts will be announced on www.mass.gov/salaryreserve
- Appeals process opens on November12 and closes on November 28: Appeal forms and instructions to appeal will be available on the salary reserve web page.
- November 14 – 21, 2008: Salary Reserve contracts emailed to Providers for signature.
- November 28, 2008: Deadline for receipt of provider’s signed contracts at EOHHS.
