DUTY TO PROVIDE RECORDS TO PATIENT OR REPRESENTATIVE
(M.G.L.. c. 112, s. 12CC)

Since many complaints received by the board relate to patient requests for copies of records, the board advises all licensees to review Mass. Gen. Laws Chapter 112, section 12CC. This statue provides, in part, that "a health care provider who maintains records for a patient treated or examined by such provider shall permit inspection of such records by such patient or an authorized representative of the patient, and upon request and payment of a reasonable fee shall make a copy of such patient records available to such patient or such representative".
