DECISION
A Commission hearing was held to determine whether the licensee Jalaram Kutir, Inc. d.b.a. Best Western Hotel violated 204 CMR 2.05(2)- Permitting an illegality on the licensed premises, to wit; M.G.L. Ch.94 §186- falling below the standards of purity (7 Counts).
The licensee stipulated to the facts of the investigator’s report. Investigator Capurso stated that on February 16, 2006 he and Investigator Hooton were inspecting the licensed premises when they observed fruit flies in 7 bottles of liquor. The Commission finds that the licensee violated CMR 2.05- permitting an illegality on the licensed premises and suspends the license for 7 days. The Commission will suspend 3 days of said penalty for a period of 1 year.
