DECISION

This was a hearing to determine whether Woburn Restaurant Associated Limited Partnership d.b.a. T.G.I Friday’s violated Ch. 138 §69- Sale or delivery to intoxicated persons (2 Counts).

The licensee agreed to the stipulated facts of the investigators report dated December 22, 2005. ABCC investigator’s entered T.G.I Friday’s to inspect its business operation. They noticed two gentlemen with glassy eyes and slurred speech attempting to talk to each other. The investigators formed the opinion they were intoxicated and proceeded to watch them be served draft beers by the bartender. While the investigators were watching the men got into a loud altercation with one of the men pushing the other against the wall. When the investigators identified themselves one of the patrons became confrontational with them. The Woburn Police Department ultimately placed one patron into protective custody.

The attorney for the licensee testified this was the first violation by the licensee in 11 years of ownership.

The Commission finds the licensee did violate Ch. 138 §69- Sale or delivery to intoxicated persons (2 Counts) and therefore, suspends the license for a period of 6 days in which 3 must be served. The remaining 3 days will be held for one year providing no further violations of Ch. 138 or Commission regulations are found.
