DECISION

This was an appeal from the action of the licensing board of the city of Pittsfield in revoking the license of Arace’s, Inc. d.b.a The Vineyard Macaroni Grill.

The city of Pittsfield did not appear for the hearing. The local board decision was marked as exhibit I. The licensee, James Arace stated that he purchased the building in 1974. He owes about $30,000 in property taxes and is trying to sell the building. He has owed the taxes for the last year.

Based on the lack of evidence caused by the failure of the board to appear, the Alcoholic Beverages Control Commission disapproves the action of the local board and remands the matter to the local board.
