DECISION

This was a hearing concerning alleged violation of 204 CMR 2.05 (2)-Permitting an illegality on the licensed premises to wit, Ch.138 §34- Sale or delivery of an alcoholic beverage to a person under 21 years of age.

The licensee stipulated to the facts of the investigator’s report, which stated that, an underage operative, under the supervision of A.B.C.C. investigators went to the licensed establishment. The minor, whose date of birth is 05/20/1989 making her 17, ordered a Budweiser for which she paid $2.25. She was not asked for identification.

Based on the evidence, the Alcoholic Beverages Control Commission finds that the licensee violated 204 CMR 2.05 (2)- Permitting an illegality on the licensed premises to wit, Ch.138 §34-Sale or delivery of an alcoholic beverage to a person under 21 years of age and, therefore, suspends the license for a period of 6 days of which 2 will be suspended providing no other violations of Ch.138 or Commission regulations are found within 1 year.
