DECISION
A Commission hearing was held to determine whether Reflection Liquors, Inc., d.b.a. Karl’s Landmark violated 204 CMR 2.05 (2)- Permitting an illegality on the licensed premises, to wit: Ch.94 §186- Falling below the standards of purity (fruit flies/foreign matter). (11 Counts).
The licensee stipulated to the facts contained in the investigator’s report dated June 29, 2006. The report states A.B.C.C. investigators and members of the Dennis Code Enforcement Task Force conducted an inspection of the bar area of Karl’s Landmark. They discovered eleven bottles of alcohol, which contained fruit flies. The bottles were (1) bottle of Tribuno Extra Dry Vermouth, (1) bottle of Dewar’s Scotch Whiskey, (1) bottle of Canadian Club Whiskey, (1) bottle of Triple Sec Liqueur, (1) bottle of Jack Daniel’s Whiskey, (1) bottle of Seagram’s Seven Crown Whiskey, (1) bottle of Johnnie Walker Black Label Whiskey, (1) bottle of Jose Cuervo Tequila, (1) bottle of Chivas Regal Whiskey, (1) bottle Jameson Irish Whiskey and (1) bottle of Sutton Club Bourbon Whiskey.
The Commission finds that the licensee did violate Ch.94 §186- Falling below the standards of purity (fruit flies/foreign matter) (11 Counts), and therefore, suspends the license for 11 days of which 6 must be served and 5 shall be suspended for a period of two years providing no further violations of Ch.138 or Commission regulations occur.
