DECISION
A Commission hearing was held to determine whether Asian Kingdom, Inc. d.b.a. Tai Cha Da Restaurant violated 204 CMR 2.05 (2)- Permitting an illegality on the licensed premises; to wit: Ch.138 §34- Sale or delivery of an alcoholic beverage to a person under 21 years of age. (1 Count).
The licensee stipulated to the facts of the investigators report and the Commission finds said facts contained therein. This was a violation found pursuant to a sting operation conducted by the A.B.C.C. Investigator Paul Capurso testified that pursuant to a sting operation, the operative a twenty year old, purchased a Bud Beer in the amount of $2.89. The licensee did not card the operative.
The Commission finds the licensee in violation of 204 CMR 2.05 (2)- Permitting an illegality on the licensed premises; to wit: Ch.138 §34- Sale or delivery of an alcoholic beverage to a person under 21 years of age. The Commission herein suspends the licensee’s license for a period of three days.
