Pesticide Enforcement
The Pesticide Program is given primacy for the enforcement of all pesticide Regulations in the Commonwealth of Massachusetts. Pesticide Enforcement administers the provisions of the Massachusetts Pesticide Control Act and the regulations 333 CMR 1- 13. In addition the Department is designated as the state lead agency for the enforcement of the federal pesticide statute (FIFRA) by the US EPA.
Inspectors investiagte allegations of pesticide misuse and inspect dealer establishments, pest control businesses and pesticide producer establishments.
Legal actions are initiated by the Department of Agricultural Resources [DAR]. Civil and Criminal prosecution is handled for DAR by the District Attorney or the Office of the Attorney General. Penalties for violation of the MPCA or of the regulations of 333 CMR range from warnings to loss of license to fines and possible imprisonment. Administrative enforcement procedures, such as warnings and loss of license is handled by the DAR
