Enforcement
The Pesticide Bureau must enforce
the Massachusetts Pesticide Control Act and the regulations 333 CMR. In
addition the Department is designated by the USEPA as the state lead agency
of the federal pesticide statute (FIFRA).
Inspectors respond to allegations of pesticide misuse and inspect dealer
establishments, pest control businesses and pesticide producer establishments.
Legal actions are initiated by the DFA. Civil and Criminal prosecution
is handled for the DFA by the District Attorney or the Office of the Attorney
General. Penalties for violation of the MPCA or of the regulations of
333 CMR range from warnings to loss of license to fines and possible
imprisonment. Administrative enforcement, such as warnings and loss of
license is handled by the DFA.
