To be eligible for certification, your organization must be:

  • Ongoing - regularly and actively engaged in business activity.
  • Control - the eligible Directors/Trustees control the organization
  • Independent - not dependent upon or influenced by another non-eligible business or organization

An organization is not eligible if it has been established or reorganized for the specific purpose of taking advantage of the SDO certification program.

Note: Prospective business activity is not normally sufficient to meet the ongoing business requirement. There is no requirement as to the length of time in organization or volume of services. However, without control of the eligible Directors/Trustees over the day-to-day activities of the organization, it would be difficult to demonstrate that it's "ongoing" within the meaning of the regulations.

Ongoing

To qualify as being ongoing, you must provide evidence that your organization:

  • Is regularly and actively engaged in its prescribed activity.
  • Has an established place of operations.
  • Uses finances and other resources that are independently owned or leased.
  • Has substantial marketing activity.
  • Has, or is about to have a revenue stream.
  • Owns or leases the resources that are typical for an organization of its service industry.
  • Is in a facility appropriate for the service area of its type at the present stage of development of the organization.

If the non-profit is newly incorporated, it must be able to demonstrate that it is an ongoing concern in the service area in which it requests certification.

Control

The eligible Directors/Trustees of the applicant non-profit must exercise dominant control over policy and financial planning and set and monitor standards for day-to-day control of the organization. These conditions should be reflected in the non-profit organization's corporate documents. Again, if there is a voting membership entitled to elect the Board of Directors/Trustees, fifty-one percent (51%) of the voting membership must be either minority group members or women.

Independence

Independent means that the applicant is not dependent upon, affiliated with or influenced by - legally or in practice - any non-eligible business, agency or organization to perform its financial planning, policy-making decisions or to perform the business activity of the organization.
