Important Notice for Entry-Level Applicants
Who Are or Will Be Turning Age 32

This notice will inform you of the following local option legislation that was effective November 8, 2000, and its impact on candidates for entry-level public safety positions.

Section 58A. Notwithstanding the provisions of any general or special law to the contrary, in any city, town or district that accepts this section, no person shall be eligible to have his name certified for original appointment to the position of firefighter or police officer if such person has reached his thirty-second birthday on the date of the entrance examination. Any veteran shall be allowed to exceed the maximum age provision of this section by the number of years served on active military duty, but in no case shall said candidate for appointment be credited more than four years of active military duty. Approved August 10, 2000.

The municipalities that are most likely to accept this legislation are those noted on the entry-level public safety examination announcements under the category "Medical and Physical Fitness Standards". These are the communities that had no upper age limit for hiring police officers or firefighters because they had accepted other earlier legislation. Please contact the municipality in which you are interested in working to determine if/when the community may accept the provisions of section 58A.

You should also take this information into account as you decide on the communities in which you wish to work. For example, if you are not a veteran and are over the age of 32 and your home community is one that currently accepts applicants over the age of 32, you may want to check with the fire or police department to determine if the municipality is considering accepting section 58A. If, prior to the establishment of the eligible list from an examination or during the life of the current list for police officer or firefighter, your hometown elects to accept this legislation, you may not have an opportunity to be considered for appointment in your hometown.

If, however, you are a qualified veteran, either still in or released from the military, you may add up to a maximum of four years of service time to your age (to a maximum age of 36) and still be eligible for appointment in municipalities that have accepted section 58A. Please resubmit a copy of your DD Form 214 (Member-4 version) to the

with a transmittal letter advising of your wish to take advantage of the option to have your years of service applied to the upper-age limit. If you are still in military service but qualify for veteran status, you may supply proof, on official letterhead with appropriate signature, of your military service to date, including the dates of active duty, current assignment, and estimated time of separation. When you are released from the military, you must submit to HRD a copy of your DD Form 214 (Member-4 version) that clearly identifies your years of service (beginning and end dates) to serve as verification of your request to have these years added to your age so that you may be considered for employment in said municipal departments.

At the examination site, you (veterans and civilians alike) will choose the municipalities in which you would like to be considered for work. You may select three municipalities in addition to your resident community. If, at that time, you learn that your resident municipality has accepted the provisions of section 58A and you are beyond the age limit to be considered in your hometown, you may select a fourth municipality as one of your choices.

If, during the life of the eligible list, your hometown accepts this legislation and you are beyond the age limit for employment, you may advise HRD in writing that you want to remove your residency preference municipality for this reason and replace it with another.
