This workshop is geared to assisting the MBE/WBE community in becoming DCAM-certified. This program will cover the DCAM Certification Application requirements and the process for becoming certified as a Prime Contractor & Filed Sub-bidder for those parties interested in bidding on M.G.L. Chapter 149 and 149A vertical building construction work in the Commonwealth. Additional information will be provided on the bidding process and requirements. DCAM presenters will include Deputy General Counsel Susan Goldfischer, Manager of Contractor Certification Natasha Bizanos, and Assistant Certification Officer Harry Schoenbrun.

DOES YOUR FIRM NEED DCAM CERTIFICATION TO BID ON PUBLIC PROJECTS AND IF SO WHAT YOU NEED TO KNOW

I.  DCAM Certification of Prime/General Bidders is required for all building projects bid under Massachusetts General Laws, Chapter 149, §44A-J or Chapter 149A. 

Vertical Construction Contract Procurements are subject to M.G.L. c. 149, §44A-J and/or c. 149A if:

•  The project is put out to bid by a Massachusetts public agency (including state agencies, authorities, counties, cities and towns); and
•  It is for the construction, reconstruction, demolition, maintenance, or repair of a building; and
•  It is estimated to cost over $100,000.

A DCAM Certificate of Eligibility is not required for:

•  Highway, bridge, tunnel, sewer, site work, or other horizontal projects that do not involve buildings.
•  Projects estimated to cost $100,000 or less.
•  Subcontractors submitting prices on these projects are divided into two categories, those submitting bids as “filed sub-bidders/trade contractors” and all others.

Firms providing services in the following trades, enumerated in M.G.L. c. 149, §44F, are subject to the filed sub-bid/trade contractor procurement laws (see certification information below): masonry; miscellaneous and ornamental iron; waterproofing, dampproofing and caulking; roofing and flashing; metal windows; glass and glazing, lathing and plastering; marble; tile; terrazzo; acoustical tile; resilient floors; painting; elevators; plumbing; HVAC; electrical; and on certain projects, fire protection. Firms providing pricing or proposals for scopes of work, other than the above listed trades, are not required to have a DCAM Certificate of Eligibility.

A. Requirements for Consideration of Prime/General Contractor Certification

1. Firm must have been in business for at least one year in the category of work for which certification is sought.

2. Firm must have successfully completed a minimum of five (5) projects, each with a minimum value of $80,000, within the past five years in each category of work in which it is seeking certification.

3. Firm must have a CPA-reviewed or CPA-audited financial statement from the most recent year-ended.

4. Firm must have an established bonding capacity with minimum single and aggregate project limits in excess of $100,000 with a surety that is licensed to do business in the Commonwealth of Massachusetts and is on the most recent list of approved sureties issued by the United States Department of the Treasury.

II.  DCAM certification of Filed Sub-bidders/Trade Contractors is required for all building projects put out to bid under Massachusetts General Laws, Chapter 149, §44A-J or Chapter 149A. 

Filed sub-bidder/trade contractor contract procurement is subject to M.G.L. c. 149, §44A-J and/or c. 149A if:

•  The project is put out to bid by a public agency (including state agencies, authorities, counties, cities and towns); and
•  It is for the construction, reconstruction, demolition, maintenance, or repair of a building in any of the seventeen Categories of Work outlined in M.G.L. c. 149 §44F and set forth above; and
•  The entire project is estimated to cost over $100,000; and
•  The filed sub-bid/trade contractor category of work is estimated to cost over $20,000.

A DCAM Filed Sub-bidder Certificate of Eligibility is not required for:

•  Highway, bridge, tunnel, sewer, site work, or other horizontal projects that do not involve buildings
•  Projects in which the filed sub-bid Category of Work is estimated to cost $20,000 or less
•  Subcontractors submitting pricing and proposals for work that is not subject to filed sub-bid/trade contractor procurement laws under M.G.L. c 149, §44F (work outside of the 17 trades listed above).

A. Requirements for Consideration of Sub-Bidder Certification

1. Firm must have been in business for at least one year in the category of work for which certification is sought.

2. Firm must have successfully completed a minimum of three (3) projects, each with a minimum value of $20,000, within the past three years in each category of work in which you’re seeking certification.

3.  Firm must have a CPA-compiled, CPA-reviewed, or CPA-audited financial statement from the most recent year-ended.
