Budgetary Direct Appropriations

DEPARTMENT OF HIGHWAYS ADMINISTRATION

For personnel services of the department of highways, certain administrative and engineering expenses and equipment of the highways commission, the office of the highways commissioner, the division of administrative services, highway engineering, highway maintenance, highway construction, the outdoor advertising board, district and other highway activity offices, materials, supplies, fleet maintenance and equipment, general maintenance and equipment, the maintenance and operation of state highways, parkways and bridges, and for workers` compensation-related expenditures for employees of the department; provided, that the department shall seek the maximum federal reimbursement for personnel costs in this item associated with federal projects; provided further, that notwithstanding the provisions of any general or special law or administrative bulletin to the contrary, the department shall not pay to the operational services division any fees charged for the leasing or maintenance of vehicles; provided further, that this item shall be the only source of funding for all overtime expenses associated with the department`s snow and ice control efforts; and provided further, that the department shall not be subject to the provisions of section 22 of chapter 7 and section 36A of chapter 30 of the General Laws, but shall submit to the secretary of transportation and construction for approval requests to repair vehicles costing in excess of the limit set forth in said section 22

CHAPTER 90 REIMBURSEMENTS TO MUNICIPALITIES
6037-0011  

For construction and reconstruction projects on town and county ways as described in subdivision (a) of clause (2) of the first paragraph of section 34 of chapter 90 of the General Laws; provided, that cities and towns shall comply with the procedures related to such projects established by the department of highways; provided further, that cities and towns may appropriate for such projects amounts not to exceed the amounts provided to them under this item; provided further, that such appropriation shall be considered as an available fund upon the approval of the commissioner of revenue pursuant to section 23 of chapter 59 of the General Laws; and provided further, that the commonwealth shall reimburse a city or town for expenses of such projects within 30 days of receipt by the department of a request for reimbursement from such city or town, which request shall include certification by such city or town that actual expenses have been incurred on projects eligible for reimbursement under this item, and that the work has been completed to the satisfaction of such city or town according to the specifications of said projects and in compliance with applicable law and said procedures established by the department
