For the operation of the department of environmental protection, notwithstanding the provisions of section 323F of chapter 94 of the General Laws; provided, that the provisions of section 3B of chapter 7 of the General Laws shall not apply to fees established pursuant to section 18 of chapter 21A of the General Laws; provided further, that appropriations made available by this act for ordinary maintenance of said department from state funds other than the Environmental Challenge Fund and the Environmental Permitting and Compliance Assurance Fund shall be deemed a determination that the funding is comparable to the baseline figure defined in subsection (m) of section 18 of chapter 21A of the General Laws
