For the operation of the division of health care finance and policy, and the administration of the uncompensated care pool; provided, that the division, in consultation with the division of medical assistance, shall not promulgate any increase in Medicaid provider rates above existing rates without taking all measures possible under Title XIX of the Social Security Act or any successor federal statute to ensure that rates of payment to providers do not exceed such rates as are necessary to meet only those costs incurred by efficiently and economically operated providers in order to provide services of adequate quality; provided further, that the division shall share financial data and expertise about the Massachusetts health care industry with the Massachusetts institute for social and economic research for the purpose of enhancing, developing, and marketing data products for the public; provided further, that the division and the institute shall share any revenue generated through the licensure, royalty, and usage fees charged for said data products; provided further, that notwithstanding the provisions of any general or special law to the contrary, the amount assessed to acute hospitals in fiscal year 2002 for the estimated expenses, including indirect costs, of the division of health care finance and policy shall be equal to the amount appropriated in items 4100-0060 and 4100-0085 less amounts projected to be collected in fiscal year 2002 from (1) filing fees, (2) fees and charges generated by the division's publication or dissemination of reports and information, and (3) federal financial participation received as reimbursement for the division's administrative costs; and provided further, that said assessed amount shall be not less than 65 per cent of the division's expenses as specified herein

| CERTIFIED NURSING ASSISTANT WAGE INCREASE AUDITS |

For the purpose of conducting semi-annual audits of wage increases and related employee costs for any category of direct care workers at nursing facilities expended pursuant to specific provisions of the 2000 and 2001 nursing facility regulations promulgated by the division of health care finance and policy; provided, that said division, in consultation with the division of medical assistance, shall recoup in accordance with applicable law any monies expended in violation of said provisions; provided further, that nursing facilities receiving payments pursuant to said regulations shall certify in writing to the division of health care finance and policy that said payments are being used exclusively for the purposes enumerated in said provisions; provided further, that said written certification shall establish the amounts projected to be paid in fiscal year 2002 for said increased wages and related employee costs; provided further, that said audits shall establish the veracity of such written certification; and provided further, that the division of health care finance and policy shall submit to the house and senate committees on ways and means and the joint committee on health care a report at the end of said fiscal year on the amounts recouped in said fiscal year and projected to be recouped in fiscal year 2003 from violations of said provisions

| GRANTS TO EXPAND OUTPATIENT CAPACITY |

For the purpose of awarding one-time grants to community health centers for capital, equipment, and start-up costs to increase outpatient capacity or to establish innovative approaches to divert non-emergency visits from hospital emergency departments; provided, that the criteria for awarding such grants shall include, but not be limited to, the extent to which hospital emergency departments in the geographic service area are on diversion status, the lack of sufficient access to low cost outpatient health services in the geographic service area of an applicant, the ability of an applicant to implement cost-effective services at a lower unit cost than services currently available in the geographic area; the ability of an applicant to financially sustain the program in future years, the long term viability of an applicant, and any other criteria the commissioner of health care finance and policy deems appropriate; provided further, that any documentation requested by the division of health care finance and policy to substantiate grant applications shall be made available to said division by an applicant; provided further, that the division may award grants subject to conditions, including but not limited to, conditions related to furtherance of state health policy or implementation of the project funded by the grant; provided further, that an advisory group consisting of the secretary of health and human services, who shall chair the group, or his designee, the commissioner of medical assistance, or his designee, a representative of the bureau of health quality management in the department of public health, a representative of the bureau of family and community health in the department of public health, a representative of the Massachusetts League of Community Health Centers, a representative of the American College of Emergency Room Physicians, and a representative of the Massachusetts Hospital Association shall recommend to the commissioner of health care finance and policy not later than 45 days after the effective date of this act the most efficacious means of awarding said grants consistent with the provisions of this item; provided further, that no grant may exceed $500,000; provided further, that grants shall be awarded not later than six months after the effective date of this act; and provided further, that the commissioner of health care finance and policy shall submit a report to the secretary of health and human services and the house and senate committees on ways and means when grants are awarded, specifying which community health centers will receive funds from this item and the amounts and uses of the awards

| SURVEY OF THE UNINSURED AND UNDERINSURED |

For a survey and study of the uninsured and underinsured in the commonwealth, including the health insurance needs of the residents of the commonwealth and specific urban areas of the commonwealth; provided, that said study shall examine the overall impact of programs administered by the division and the division of medical assistance on the uninsured, the underinsured, and the role of employers in assisting their employees in affording health insurance pursuant to section 23 of chapter 118G of the General Laws; provided further, that notwithstanding the provisions of any general or special law to the contrary, the amount assessed to acute hospitals in fiscal year 2002 for the estimated expenses, including indirect costs, of the division of health care finance and policy shall be equal to the amount appropriated in items 4100-0060 and 4100-0085 less amounts projected to be collected in fiscal year 2002 from (1) filing fees, (2) fees and charges generated by the division's publication or dissemination of reports and information, and (3) federal financial participation received as reimbursement for the division's administrative costs; and provided further, that said assessed amount shall be not less than 65 per cent of the division's expenses as specified herein
