For the operation of the executive office, including the operation of the managed care oversight board; provided, that the executive office shall provide technical and administrative assistance to agencies under the purview of the secretariat receiving federal funds; provided further, that the executive office shall monitor the expenditures and completion timetables for systems development projects and enhancements undertaken by all agencies under the purview of the secretariat and shall ensure that all measures are taken to make such systems compatible with one another for enhanced interagency interaction; provided further, that the executive office shall continue to develop and implement the common client identifier; provided further, that funds appropriated herein shall be expended for the administrative, contracted services, and non-personnel systems costs related to the implementation and operation of programs authorized by sections 9A, 9B, 9C, 16B, and 16C of chapter 118E of the General Laws; provided further, that in consultation with the division of health care finance and policy, no rate increase shall be provided to existing Medicaid provider rates without taking all measures possible under Title XIX of the Social Security Act to ensure that rates of payment to providers do not exceed such rates as are necessary to meet only those costs which must be incurred by efficiently and economically operated providers in order to provide services of adequate quality; provided further, that expenditures for the purposes of each item appropriated for the purpose of programs authorized by chapter 118E of the General Laws shall be accounted for according to such purpose on the Massachusetts management accounting and reporting system not more than 10 days after such expenditures have been made by the Medicaid management information system; provided further, that no expenditures shall be made for the purpose of such programs authorized by said chapter 118E that are not federally reimbursable, except as specifically authorized herein, or unless made for cost containment efforts the purposes and amounts of which have been submitted to the house and senate committees on ways and means 30 days prior to making such expenditures; provided further, that the executive office may collect directly from a liable third party any amounts paid to contracted providers under said chapter 118E for which the executive office later discovers another third party is liable if no other course of recoupment is possible; provided further, that no funds shall be expended for the purpose of funding interpretive services directly or indirectly related to a settlement or resolution agreement with the office of civil rights or any other office, group, or entity; provided further, that interpretive services currently provided shall not give rise to enforceable legal rights for any party or to an enforceable entitlement to interpretive services; provided further, that the federal financial participation received from claims filed for the costs of outreach and eligibility activities performed at certain hospitals or by community health centers which are funded in whole or in part by federally permissible in-kind services or provider donations from the hospitals or health centers, shall be credited to this item and may be expended without further appropriation in an amount specified in the agreement with each donating provider hospital or health center; provided further, that the federal financial participation received from claims filed based on in-kind administrative services related to outreach and eligibility activities performed by certain community organizations, under the so-called "covering kids initiative" and in accordance with the federal revenue criteria in 45 CFR 74.23 or any other federal regulation which provides a basis for federal financial participation, shall be credited to this item and may be expended, without further appropriation, on administrative services including those covered under an agreement with the organizations participating in the initiative; provided further, that notwithstanding the provisions of any general or special law to the contrary, the executive office shall require the commissioner of mental health to approve any prior authorization or other restriction on medication used to treat mental illness in accordance with written policies, procedures, and regulations of the department of mental health; provided further, that the secretary of the executive office of health and human services may authorize transfers among items 4000-0430, 4000-0500, 4000-0600, 4000-0620, 4000-0700, 4000-0860, 4000-0870, 4000-0875, 4000-0880, 4000-0890, 4000-0891, 4000-0895, 4000-0990, 4000-1400, and 4000-1405; provided further, that the amount transferred from any of the items stated herein shall not exceed 10 per cent of the total amount appropriated for that item; and provided further, that any such transfer shall take place no later than June 30, 2006 |

For a program of transitional aid to families with dependent children; provided, that notwithstanding the provisions of any general or special law to the contrary, benefits under said program shall be paid only to citizens of the United States and to non-citizens for whom federal funds may be used to provide benefits; provided further, that the need standard shall be equal to the standard in effect in fiscal year 2005 unless the department determines that a reduction in the monthly payment standard should be implemented before the end of the fiscal year to keep program expenditures within the amounts appropriated herein; provided further, that the payment standard shall be equal to the need standard; provided further, that the payment standard for families who do not qualify for an exempt category of assistance under the provisions of subsection (e) of section 110 of chapter 5 of the acts of 1995 shall be 2.75 per cent below the payment standard, pursuant to the provisions of the state plan required under the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, so called; provided further, that the preceding proviso shall not be effective upon the effective date of any related revision to the welfare reform law, so-called; provided further, that the department of transitional assistance shall notify all teen parents receiving benefits from said programs of the requirements in clause (2) of subsection (i) of said section 110; provided further, that a $40 per month rent allowance shall be paid to all households incurring a rent or mortgage expense and not residing in public housing or subsidized housing; provided further, that a non-recurring children's clothing allowance in the amount of $150 shall be provided to each child eligible under these programs in September 2005; provided further, that benefits under this program shall not be available to those families in which a child has been removed from the household pursuant to a court order after a care and protection hearing on child abuse, nor to adult recipients otherwise eligible for transitional aid to families with dependent children but for the temporary removal of the dependent child or children from the home by the department of social services in accordance with said department's procedures; provided further, that notwithstanding the provisions of section 2 of chapter 118 of the General Laws or any other general or special law to the contrary, the department shall render aid to pregnant women with no other eligible dependent children only if it has been medically verified that the child is expected to be born within the month such payments are to be made or within the three-month period following such month of payment, and who, if such child had been born and was living with her in the month of payment would be categorically and financially eligible for transitional aid to families with dependent children benefits; and provided further, that certain families that suffer a reduction in benefits due to a loss of earned income and participation in retrospective budgeting may receive a supplemental benefit to compensate them for such loss |

For a program of cash assistance to certain residents of the commonwealth pursuant to chapter 117A of the General Laws, entitled emergency transitional assistance, who are found by the department of transitional assistance to be eligible for such aid, pursuant to regulations promulgated by the department and subject to the limitations specified herein; provided, that benefits under this item shall be provided only to residents who are citizens of the United States or qualified aliens, so called, or non-citizens otherwise permanently residing in the United States under color of law and shall not be provided to illegal or undocumented aliens; provided further, that the department shall promulgate regulations to implement the deeming of income from sponsors; provided further, that the preceding proviso shall not apply to those who reside in an institution; provided further, that the monthly payment standard for the program shall equal the monthly payment standard in effect under this program in fiscal year 2005, unless the department of transitional assistance determines that a reduction in the monthly payment standard should be implemented before the end of the fiscal year to keep program expenditures within amounts appropriated herein; provided further, that notwithstanding any such reduction in the monthly payment standard, the department may continue to provide benefits for eligible individuals in rest homes; provided further, that the department may provide benefits to persons age 65 or older who have applied for benefits under chapter 118A of the General Laws, to persons suffering from a medically determinable impairment or combination of impairments which is expected to last for a period as determined by department regulations and which substantially reduces or eliminates the individual's capacity to support himself, and has been verified by a competent authority, to otherwise eligible participants in the vocational rehabilitation program of the Massachusetts rehabilitation commission, to certain persons caring for a disabled person, to dependent children who are ineligible for benefits under both chapter 118 of the General Laws and the separate program created by section 210 of chapter 43 of the acts of 1997, and to parents or other caretakers of dependent children who are ineligible under said chapter 118 and under said separate program; provided further, that a person shall not be eligible for assistance under the provisions of this item if the person is eligible to receive assistance under chapters 115 or 118 of the General Laws or who would be eligible under said chapter but for income or assets or who is eligible to receive unemployment compensation under chapter 151A of the General Laws; provided further, that the department may institute a work requirement for adult recipients; provided further, the preceding proviso shall not apply to the elderly, those who reside in an institution, or those with a disability expected to last for six months or less; provided further, that the department shall promulgate regulations establishing exceptions for good cause for not meeting the work requirement; provided further, that no ex-offender, person over age 45 without prior work history, or person in a residential treatment facility shall be eligible for benefits under this program unless said person otherwise meets the eligibility criteria described herein and defined by regulations of the department; provided further, that any person incarcerated in a correctional institution shall not be eligible for benefits under this program; provided further, that no funds shall be expended from this item for the payment of expenses associated with any medical review team or other disability screening process or for any costs associated with verifying disability for this program; provided further, that funds may be expended from this item for self sufficiency activities for recipients; provided further, that in promulgating, amending, or rescinding regulations with respect to eligibility or benefits under this program, the department shall take into account the amount available to it for expenditure from this item so as not to exceed the amount appropriated herein; provided further, that the department may promulgate emergency regulations pursuant to chapter 30A of the General Laws to implement these eligibility or benefit changes or both; and provided further, that notwithstanding the provisions of any general or special law to the contrary, the funds made available herein shall be the only funds available for this program, and the department shall not spend funds for this program in excess of the amount made available herein |
