Charter School Cap Elimination

SECTION 60.   Subsection (i) of section 89 of chapter 71 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by striking out the third sentence and inserting in place thereof the following sentence:- In any fiscal year, a public school district's total charter school tuition payment to commonwealth charter schools shall not exceed 9 per cent of said district's net school spending; provided, that if the board determines the MCAS scores for the school district place said district in the lowest 10 per cent of all districts statewide MCAS test performance scores for two consecutive years there shall be no limit on said public school's total charter school tuition payment to commonwealth charter schools.
