Muir arraigned on sexual assault charges

A Stockbridge man was arraigned this afternoon in Great Barrington District Court on sexual assault charges.  36 year old SCOTT M. MUIR (33 Church Street) appeared before Judge Bethzaida Sanabria-Vega.        

MUIR had not guilty pleas entered on his behalf on three (3) counts of RAPE OF A CHILD: WITH FORCE and two (2) counts of INDECENT ASSAULT AND BATTERY ON A CHILD UNDER 14 in connection with incidents that occurred between 2003 and 2005 and involved a girl who is now 16 years of age.

 MUIR also had not guilty pleas entered on two (2) counts of INDECENT ASSAULT AND BATTERY ON A CHILD UNDER 14 and one (1) count of ATTEMPT TO COMMIT A CRIME, TO WIT: INDECENT ASSAULT AND BATTERY ON A CHILD UNDER 14.  The incidents are alleged to have occurred in 2003 and 2004 and involved a girl who is now 18.

MUIR also pleaded not guilty to one (1) count of RAPE OF A CHILD: WITH FORCE and two (2) counts of INDECENT ASSAULT AND BATTERY ON A CHILD UNDER 14 in connection with incidents that allegedly occurred in 2003 and 2004 and involved a girl who is now 17 years of age. 

All the incidents are alleged to have occurred in Stockbridge at the Stockbridge Plain School where MUIR was employed as a School Adjustment Councilor. 

 Judge Sanabria-Vega released MUIR on $10,000 cash or $100,000 surety bail on the condition he wear a GPS monitor, have no contact with the alleged victims or their families and have no unsupervised contact with children under 16.  MUIR will be back in court for pre-trial conference on May 3, 2012. 

District Attorney David F. Capeless stated, “We believe that there may be other victims who will come forward, and we urge anyone with information about Mr. Muir’s activities at the Plain School to contact the Berkshire Detective Unit of the State Police at (413) 499-1112.    

The investigation was conducted by State Police detectives assigned to the District Attorney’s Office.
