Simonetta pleads guilty, sent to jail

A Pittsfield man pleaded guilty this afternoon in Berkshire Superior Court to several charges.  39 year old DOMINIC J. SIMONETTA appeared before Judge John Agostini. 

SIMONETTA pleaded guilty to two (2) counts of ASSAULT AND BATTERY BY MEANS OF A DANGEROUS WEAPON, two (2) counts of ASSAULT BY MEANS OF A DANGEROUS WEAPON and two (2) counts of ASSAULT AND BATTERY in connection with an incident involving a 43 year old woman, in Pittsfield, on January 4, 2010 and June 3, 2010. 

SIMONETTA also pleaded guilty to three (3) counts of ASSAULT AND BATTERY BY MEANS OF A DANGEROUS WEAPON, one (1) count of ASSAULT BY MEANS OF A DANGEROUS WEAPON, one (1) count of ASSAULT AND BATTERY, one (1) count of INTIMIDATION OF A WITNESS OR OTHER PERSON and one (1) count of THREAT TO COMMIT A CRIME, TO WIT: MURDER in connection with incidents that occurred in Pittsfield and involved a 43 year old woman between October 2, 2011 and October 6, 2011. 

Judge Agostini ordered that SIMONETTA serve concurrent 2 and a half year sentences at the Berkshire County House of Correction on three (3) counts of ASSAULT AND BATTERY BY MEANS OF A DANGEROUS WEAPON, three (3) counts of ASSAULT BY MEANS OF A DANGEROUS WEAPON, two (2) counts of  INTIMIDATION OF A WITNESS OR OTHER PERSON and two (2) counts of ASSAULT AND BATTERY.  He was placed on 2 years probation on two (2) counts of ASSAULT AND BATTERY BY MEANS OF A DANGEROUS WEAPON on the condition SIMONETTA refrain from using drugs and alcohol, undergo testing and counseling and not have any contact with the victim during the probationary period.  He was also given a 6 month concurrent house of correction sentence on the charge of THREAT TO COMMIT A CRIME.        

One (1) count of KIDNAPPING, two (2) counts of ASSAULT AND BATTERY BY MEANS OF A DANGEROUS WEAPON and two (2) counts of INTIMIDATION OF A WITNESS OR OTHER PERSON, two (2) counts of ASSAULT AND BATTERY and one (1) count of ASSAULT WITH INTENT TO MURDER were dismissed at the request of the Commonwealth.    

The investigations were conducted by members of the Pittsfield Police Department.
