Smithies pleads guilty, sent to state prison

A Pittsfield man pleaded guilty this afternoon in Berkshire Superior Court to several charges.  50 year old TIMOTHY S. SMITHIES appeared before Judge John Agostini. 

SMITHIES pleaded guilty to one (1) count of RECEIVING STOLEN PROPERTY OVER $250 and one (1) count of POSSESSION OF PEPPER SPRAY WITHOUT A FIREARM IDENTIFICATION CARD in connection with an incident in Dalton on June 17, 2011.    

SMITHIES also pleaded guilty to one (1) count of RECEIVING STOLEN PROPERTY OVER $250 and one (1) count of OPERATING A MOTOR VEHICLE WITH A SUSPENDED DRIVERS LICENSE in connection with a motor vehicle stop in Lee on March 12, 2012.   

Judge Agostini ordered that SMITHIES serve a 1 to 3 year state prison sentence at the Massachusetts Correctional Institution at Cedar Junction on one (1) count of RECEIVING STOLEN PROPERTY OVER $250.  He was given a concurrent 1 year house of correction sentence on the charge of POSSESSION OF PEPPER SPRAY WITHOUT A FIREARM IDENTIFICATION CARD.  Judge Agostini also placed SMITHIES on 2 years probation on the other RECEIVING STOLEN PROPERTYcharge on the condition he remain drug and alcohol free and undergo testing during the probationary period.  The charge of OPERATING A MOTOR VEHICLE WITH A SUSPENDED DRIVERS LICENSE was filed.           

The investigations were conducted by members of the Dalton, Lee, Pittsfield and Hinsdale Police Departments.
