Moody pleads guilty, sent to state prison on drug charges

A Pittsfield man pleaded guilty this afternoon in Berkshire Superior Court to drug charges. 21 year old DENZEL C. MOODY appeared before Judge John Agostini.  

MOODY pleaded guilty to three (3) counts of DISTRIBUTION OF COCAINE and one (1) count of DRUG VIOLATION WITHIN A DRUG FREE SCHOOL ZONE in connection with incidents that occurred in Pittsfield between August 3, 2011 and August 29, 2011.   

MOODY also pleaded guilty to one (1) count of POSSESSION OF COCAINE WITH INTENT TO DISTRIBUTE, one (1) count of POSSESSION OF MARIJUANA WITH INTENT TO DISTRIBUTE, two (2) counts of DRUG VIOLATION WITHIN A DRUG FREE PARK ZONE and one (1) count of POSSESSION OF ECSTACY in connection with a motor vehicle stop in Pittsfield on January 10, 2013. 

Judge Agostini ordered that he serve concurrent 1 day sentences at the Berkshire County House of Correction on one (1) count of DISTRIBUTION OF COCAINE, one (1) count of POSSESSION OF COCAINE WITH INTENT TO DISTRIBUTE, one (1) count of POSSESSION OF MARIJUANA WITH INTENT TO DISTRIBUTE and one (1) count of POSSESSION OF ECSTACY.  MOODY was given 3 and a half to 5 year concurrent state prison sentences, to be served on and after the first sentence, on the charges of DRUG VIOLATION WITHIN A DRUG FREE SCHOOL ZONE and DRUG VIOLATION WITHIN A DRUG FREE PARK ZONE.  Judge Agostini placed him on 3 years probation on two (2) counts of DISTRIBUTION OF COCAINE on the condition MOODY remain drug and alcohol free and undergo testing and counseling during the probationary period.    

The investigations were conducted by members of the Pittsfield Police Department, the Berkshire County Sheriff’s Department and state troopers assigned to the District Attorney’s Office, members of the Berkshire County Drug Task Force.
