Smith found guilty, will be sentenced Thursday
A Dalton man was found guilty this afternoon in Berkshire Superior Court on sexual assault charges. The jury deliberated for about 2 hours before returning its verdict against 35 year old ROBERT F. SMITH.
SMITH was found guilty on five (5) counts of RAPE AND ABUSE OF A CHILD: NO FORCE, three (3) counts of RAPE AND ABUSE OF A CHILD AGGRAVATED BY AN AGE DIFFERENCE, one (1) count of INDUCING A MINOR TO ENGAGE IN SEXUAL INTERCOURSE and two (2) counts of DISSEMINATION OF OBSCENE MATTER TO A MINOR. Judge Ford ordered that he be held at the Berkshire County House of Correction without the right to bail pending sentencing which will occur on Thursday, January 24th at 2 p.m.
The incidents involved a girl who is now 17 years of age and a boy who is now 14 years old and occurred in Richmond between January 1, 2004 and June 10, 2010.
The investigation was conducted by state police detectives assigned to the District Attorney’s Office.
