Nguyen has case continued for three years

A Lee man appeared in Berkshire Superior Court this morning on several charges.  53 year old PHAP NGUYEN (175 Beartown Mountain Road) appeared before Judge John Agostini.

NGUYEN had one (1) count of ARMED ASSAULT WITH INTENT TO MURDER and one (1) count of CRUELTY TO ANIMALS continued without a change of plea for 3 years.  During that time, Judge Agostini ordered that NGUYEN take his daily medications, continue therapy and regular visits with a Department of Mental Health worker, undergo consultations to assess changes in mental and neurocognitive functioning and not possess firearms.              

It was alleged that NGUYEN shot and injured a 32 year old man who lived at the same address.  It is also alleged that NGUYEN shot and killed a dog belonging to the victim.  The incidents occurred December 13, 2012.    

The investigation was conducted by state police detectives assigned to the District Attorney’s Office, members of the Lee Police Department and troopers assigned to the Ballistics and Crime Scene Services Section of the Massachusetts State Police.
