Benjamin S. Shealey Indictment
District Attorney Michael O'Keefe announced today that on September 13, 2013 a Barnstable County Grand Jury returned an indictment against Benjamin S. Shealey (DOB 09/16/81) in connection with the July 13, 2013 motor vehicle fatality in Chatham.
Shealey was indicted with the following charges:
Manslaughter by OUI c.265/13 ½
MV Homicide OUI c.90/24G(a)
OUI Serious Injury & Reckless c.90/24L(1) (2cts)
Reckless Operation of MV c.90/24(2)(a)
Assault by DW c.265/15B
Resist Arrest c.268/32B
Fail to Stop for Police c.90/25
Unlicensed Operation MV c.90/10
Uninsured MV c.90/34J
The indictments stem from an incident that occurred on July 13, 2013 in which a motor vehicle allegedly driven by Shealey caused a collision on Route 28 in Chatham that resulted in the death of one person who was waiting for a bus on the roadside and seriously injuring two nine year olds who were passengers of a car that was struck by Shealey’s vehicle.
The case is being investigated by Chatham Police Department, Harwich Police Department and Massachusetts State Police. The case is being prosecuted by Assistant District Attorney Michelle L. Groff.
