David J. Kaeppeler Conviction

            District Attorney Michael O'Keefe announced that David J. Kaeppeler, DOB: 05/03/1967 of 1367 Peach Tree Road, Marstons Mills, was convicted of Rape; Drugging to Enable Sexual Intercourse; and Drugging to Confine yesterday after a five (5) day jury trial in Barnstable County Superior Court.

            Mr. Kaeppeler was found guilty of drugging two individuals on May 21, 2010.  The male victim awoke to Mr. Kaeppeler performing an act of oral sex upon him while his girlfriend was unconscious nearby.  A “date-rape” drug was recovered by police in Mr. Kaeppeler’s home the next day.  Both individuals were hospitalized and treated for GHB poisoning. 

            Mr. Kaeppeler was sentenced to 18-20 years MCI Cedar Junction for the Rape and Drugging to Enable Sexual Intercourse charges, and to lifetime probation for the Drugging to Confine charge by Superior Court Judge Gary A. Nickerson.  Terms and conditions for the lifetime probation included: attend sex offender counseling; no contact with the victims or their families; no harassment of the victims or their families by any means, including any social media; drug and alcohol evaluation and treatment as deemed necessary; abstention from drugs and alcohol; random breathalyzer/urine screenings; GPS monitoring; no presence where drugs and/or alcohol is kept; no working or volunteering in the food or beverage industry; no dwelling where alcohol or drugs are kept; no employment at a pharmacy or other drug dispenser; curfew from 9:00 pm to 5:00 am seven days a week; no minimization of the offense when in treatment; DNA sample; Sex Offender Registry.

            The case was investigated by the Barnstable Police Department and was prosecuted by Second Assistant District Attorney Sharon J. Thibeault.
