David A. Byron

   Cape & Islands District Attorney Michael O'Keefe announced today that David A. Byron (DOB: 12/14/1992) was sentenced in Barnstable Superior Court after pleading guilty to Aggravated Assault and Battery with a Dangerous Weapon, Unlawful Possession of a Rifle, Unlawful Possession of Ammunition and Discharging a Firearm Within 500 Feet of a Building.  

   The Honorable Gary A. Nickerson sentenced Byron to seven to eight years State Prison on the Aggravated Assault and Battery with a Dangerous Weapon charge.  With regard to the Unlawful Possession of a Rifle charge, Judge Nickerson sentenced Byron to three to three years and one day committed in State Prison concurrent.  On the remaining charges, Byron was placed on three years probation from and after the committed portion of his sentence.  

   The charges stem from an incident that occurred during the early morning hours of March 29, 2014, in a residential neighborhood in Mashpee, Massachusetts.   During the incident, Byron shot the victim using a rifle.  As a result, he suffered serious personal injury.  

   The case was prosecuted by Assistant District Attorney Edward F.X. Lynch and investigated by the Mashpee Police Department, the Barnstable Police Department, the Barnstable County Sheriff’s Department and the Massachusetts State Police.
