A recent Massachusetts Supreme Judicial Court decision, Commonwealth vs. Humberto, held that a juvenile court judge can dismiss a delinquency charge prior to arraignment when the complaint lacks probable cause and dismissal is in the best interests of the child.  Because a dismissal before arraignment prevents the offense from being entered on the youth’s record, Humberto establishes an important remedy for youth in juvenile court.
