Human Resources Department

15.000 UNEMPLOYMENT BENEFITS

A. The Trial Court is subject to the provisions of G.L. c. 151A, the Massachusetts Employment Security Law. Employees may be eligible for benefits upon separation from the Trial Court. Questions regarding unemployment compensation should be directed to the Human Resources Department or to the local Division of Employment Security.

B. If a court or Administrative Office receives a Request for Separation and Wage Information form from a local Division of Employment Security, the form should be immediately forwarded to the Human Resources Department.

C. Pursuant to GL c. 151A, s. 62A, as amended, a department head who discharges or lays off an employee who has worked for at least one week must provide the employee with a copy of the How To File For Unemployment Insurance Benefits form (Appendix C, Form F21). This form provides the employee with information on how to file for unemployment insurance benefits and must be given to the employee at the time the employee is discharged or laid off. A department head who fails to provide this form to a separated employee shall have no standing to contest such employee's claim and any benefits paid shall remain charged to the employer's account.
