The Appeals Court, together with the Supreme Judicial Court and the Massachusetts Trial Courts, is working to bring electronic filing practices into the Massachusetts State Courts. In the meantime, the Appeals Court requires that certain filings be made by e-mail and requires that others be made on paper. Learn about when you can and cannot file electronically:

 

Registration to Receive Electronic NotificationThe registration for electronic notification form pdf format of E-notification Consent , which you can access here, can be filed as a PDF copy attached to e-mail: enoticesignup@appct.state.ma.us with the subject header “Notice Consent Registration”
Change of Email Address FormSimilarly, the Change of Email Address Form pdf format of Change of E-mail Address Form can be filed as a paper copy or as a PDF to e-mail: enoticesignup@appct.state.ma.us with the subject header “Email Address Change”
Docketing Statements ( Civil pdf format of Civil Docketing Statement or Criminal pdf format of Criminal Docketing Statement )The pilot program requires all parties to save and file the form electronically as a PDF copy attached to e-mail: emotions@appct.state.ma.us (paper filing allowed only by motion).
Motion to Enlarge Time for Filing BriefShould be filed by paper copy only.
All other Motions, Oppositions to Motions or Letters filed BEFORE panel assignmentShould be filed by paper copy only except the Motion to Stay Judgment of Execution of a Sentence Pursuant to Mass. R. App. P. 6. That motion falls under the Single Justice Standing Order (see below).
Briefs

The 7 required copies of the appeals brief should be filed in hard copy only. Same with the record appendix and exhibit volumes. If you receive a PDF of the transcripts from the court transcriber, you may file a CD of the transcripts and one bound copy.

1 unbound copy of the brief and record appendix is required from DCF and CPCS for child welfare appeals only.

All Filings (Motions, Oppositions to Motions or Letters) filed AFTER Assignment of the Appeal to a Panel for Decision (Including Motion to Reschedule Oral Argument [Rule 22(a)], Motion for Additional Time for Argument, Rule 16(l) Letter):

PDF by e-mail only (NO paper copy): emotions@appct.state.ma.us. See the Appeals Court Standing Order here . This requirement is triggered upon receipt of the “Notice of Argument,” “Under Panel Consideration,” or the issuance of a decision. The subject line of the e-mail and the PDF file name should be as follows:

  • Abbreviated docket number (i.e., a two digit year followed, without a space, by a “P” followed, without a space, by the last four digits of the docket number);
  • a hyphen; and,
  • a description of the filing containing no more than 56 characters, indicating what the document is and who filed it.

Petition for RehearingPDF by e-mail only. Example subject/file name: 12P0000-Appellant Child Petition for Rehearing.pdf
 Single Justice Practice

 Anything filed to the Single Justice should be filed both electronically and in hard copy. Self-represented litigants are exempt from this requirement.

The Appeals Court has extended this requirement to also include:  Motion for Leave to File Late Notice of Appeal, Motion to Enlarge Time for Docketing, and any other Motions or Oppositions to Motions that are heard by the Single Justice.

 Petitions filed Pursuant to G. L. c. 231 § 118, para. 1

In addition to the one paper copy of the petition/opposition and all other documents that you file, you must also simultaneously file a PDF copy of the petition/opposition and supporting memoranda of law, either (1) on a CD-ROM, or (2) by e-mail (if under 10 MB) to which the PDF copy is attached. (If using e-mail, include a note that paper copy to follow.)

NOTE: a PDF copy of the record appendix should be filed if feasible, as above. (Multiple e-mails are acceptable to accommodate the size of the record appendix.)
