Civil Motor Vehicle Citation Procedures

Clerk Magistrate Hearings:
If you receive a civil motor vehicle citation issued by the local or state police in Massachusetts for a moving violation within the territorial jurisdiction of any division of the Boston Municipal Court Department, and you want a hearing with the court, you as the violator must check the correct box marked appeal request on the reverse side of the citation and mail it to the Massachusetts Registry of Motor Vehicles (RMV). Once the RMV receives your request, they will send you a letter acknowledging your request for a hearing and instructions to pay the court filing fee of twenty-five dollars and no cents ($25.00). You may pay the fee online with the RMV.
The RMV will forward to the Court the necessary documentation. The Court will send the violator a notice of hearing including the offense, address and date and time of the hearing before the Clerk Magistrate. If a conflict exists, you must contact the Court prior to the hearing date and request an alternate hearing date. On the scheduled date of the hearing, if the violator fails to appear, he/she will lose his/her right to be heard. Appeals of the
Clerk Magistrate's decision:
On the day of the Clerk Magistrate's decision, if either side is not satisfied with the decision of the Clerk Magistrate, either side may request a De Novo hearing in front of a judge of the Boston Municipal Court Department. This request to appeal must be announced immediately following the decision of the Clerk Magistrate. An appeal hearing date convenient for both parties will be scheduled after a non-refundable appeal fee of fifty dollars and no cents ($50.00) is paid to the Court (in cash or via credit card) on the day of the Clerk Magistrate's decision.
The court does not accept any payments for civil motor vehicle infractions. If you are found responsible after the Clerk Magistrate hearing, and you do not appeal the decision, you will be required to pay the amount ordered by check or money order payable to MASSDOT. Payments must be made within 20 days after the date of the judgment decision. All payments must be sent to the MASSDOT Payment Address listed below:
