Servicemembers Civil Relief Act Forms
Please note that, if no answer or appearance has been filed, the Motion for Judgment will be allowed as of the day after the return day, unless the motion is filed after the return date. This allowance will be the court's determination, as of that date, that none of the named defendants are entitled to the benefits of the Servicemembers Civil Relief Act. The judgment date will be the date the judgment is actually entered on the docket and not necessarily the date on which the Motion for Judgment is allowed.
The Land Court does not accept for filing any Servicemembers Civil Relief Act cases not accompanied by the Mortgagee's Affidavit Under Massachusetts General Laws, Chapter 244 Section 35A, as amended by St. 2010, Chapter 258, Section 7.
