The Probate and Family Court is improving access to justice by providing fillable and self calculating forms on the internet as a free service to the public.  The first group of forms are listed in the index below. Additional forms will be added as they become available.  Several of the forms have been revised. 

 

The forms and instructions provided here do not replace the legal advice or assistance which can only be provided to you by an attorney.  We urge you to consult with an attorney before completing any of these forms.

 

Using the proper form is critical to processing your court actions.  Often more than one form will be needed to process your case.

 

Some forms need to be signed in front of a notary public.  There are consequences in signing a form.  You may want to speak with a lawyer before putting your signature on a document.

All complaints and petitions must be filed at the office of the Register of Probate at the Division of the Probate and Family Court which has jurisdiction of the matter. In order to determine where to file your action, please refer to the statute noted in the instructions for the form(s) you are preparing. There is a Division of the Probate and Family Court in each county.

A filing fee must be paid when some complaints and petitions are filed. Fees may be paid with cash, money order or personal check. If you believe you cannot pay the filing fee because you are indigent, you may request that the fee be waived.

These forms can be filled out online and then printed. Please note that you should print a copy for your records, as you cannot save the information you have entered.

 

Or, you can print a copy of the blank form and fill it out manually using blue or black ink. Keep a copy for your records. The Financial Statement forms and the Child Support Guidelines Worksheet will do the mathematical calculations as the data is entered so be careful to provide accurate information.

In order to utilize these forms you must have Adobe Reader 7.0 or above software installed on your computer.
