Fine or Other Penalty
Fine of $100 and forfeiture of the marijuana
If you are under 18, you must also complete a drug awareness program.
There may be additional fines for violating a city or town by-law prohibiting smoking marijuana in public.
You must return the ticket with payment to the city or town clerk within 21 days, or to the clerk-magistrate of the District Court or Boston Municipal Court with your request for a civil hearing. The hearing may be held by a clerk or judge.
What happens if I don’t complete the drug awareness program?
If you are under 18 and don’t complete the drug awareness program and its required community service, the fine may be increased to $1,000 and you and your parents are equally liable to pay that amount. Also, failing to complete the program may be a basis for delinquency proceedings if you are under the age of seventeen at the time of the offense.
