In Commonwealth vs. Dwyer, SJC-9563, released on December 29, 2006, the Supreme Judicial Court announced a new protocol for use in criminal cases where a defendant seeks pretrial inspection of statutorily privileged records of a third party. The December 29, 2006 Supreme Judicial Court Order included the Appendix and model notices and orders
