Whether the District Court judge erred in denying the appellant's motion for an emergency hearing pursuant to G.L. c. 123, s. 12(b), upon the appellant's assertion that his involuntary confinement for twelve days under a provision that contemplated custody for no more than three days, even though a court had ordered him discharged, was the result of the hospital's abuse and misuse of the commitment procedures in violation of his rights.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
