Frank Grimaldi v. Akzo Nobel Chemicals International B.V. & others


    In this class action in which the plaintiff alleged he paid inflated prices for certain consumer products as a result of illegal price-fixing by the defendants, producers of industrial chemicals used to process rubber into substances that are then used in the manufacture of consumer products (e.g., luggage, shoes, tires, golf balls), the issue is whether the plaintiff may state a G. L. c. 93A claim as an "indirect purchaser" under Ciardi v. Hoffman- LaRoche, Ltd., 436 Mass 53 (2002).

    Interested parties may file their briefs in the Office of the Clerk for the Commonwealth, John Adams Courthouse, Suite 1-400, Pemberton Square, Boston MA 02108-1724 (Telephone 617-557-1020). Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
