THE SUPREME JUDICIAL COURT IS SOLICITING AMICUS BRIEFS OR MEMORANDA FROM INTERESTED PARTIES IN THE FOLLOWING MATTER PENDING BEFORE THE COURT

ARGUMENT WILL BE SCHEDULED IN DECEMBER 2007.

William Taylor & others v. Housing Appeals Committee & others

In these consolidated cases, the issue presented is whether the Housing
Appeals Committee was deprived of jurisdiction of an appeal when the
municipality achieved the statutory minimum obligation of affordable housing
under G. L. c. 40B, after the municipal Board of Appeals had rendered its decision
but before the Housing Appeals Committee determined the appeal therefrom. 
These cases are also paired for argument with Taylor v.  Board of Appeals of
Lexington, SJC-09993.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
