Commonwealth v. Mark Anthony

The issue presented among, others, is whether the trial judge correctly allowed suppression of items seized from a storage facility rented by the defendant and from computers the defendant had left at a repair shop, on the ground that insufficient information was contained in the affidavits in support of the warrant applications to establish the requisite nexus between the storage locker and the computers at the repair shop and the criminal activity alleged, namely, the possession of child pornography.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
