Robert Somers v. Converged Access, Inc., & another

In this claim, inter alia, for violation of the independent contractor statute, G. L. c 149, § 148B, whether the judge correctly concluded that the employer should be credited with compensation paid to a mis-classified employee to offset its liability for wage act violations, which resulted in the failure of the plaintiff to have proved damages.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
