Commonwealth v. Paul R. Shanley

Whether the defendant's motion for new trial, based on the asserted failure of trial counsel to effectively challenge the admissibility of "repressed memory" evidence, should have been allowed; whether the motion judge correctly ruled that the defendant had waived the issue of the correctness of instructions to the jury on tolling of the applicable statute of limitations.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
