Commonwealth v. Richard Kulesa

Whether the defendant's conviction of violation of G. L. c. 209A, was duplicative of a conviction for criminal harassment; whether the defendant was entitled to counsel at the trial of the subsequent offender portion of an indictment after the defendant had waived counsel on the trial of the offenses in chief; whether the judge correctly instructed the jury.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
