Town of Canton v. Luisa Paiewonsky & others

 

At issue is when a municipality is to commence an action under G. L. c. 30, § 62H; whether a Superior Court judge correctly dismissed as untimely an action challenging the adequacy and completeness of environmental reviews of a large mixed-use development in a neighboring community with respect to traffic mitigation, ruling that the permits that had issued some months earlier regarding landfill and sewer connections triggered the thirty-day filing period, even though they were not related to the issue of concern to the town

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
