Estate of Mark A. Vasa & another v. Compass Medical, P.C., & others

 

In the circumstances of a negligence action against physicians, alleging that they failed to warn their patient not to drive and alleging that the patient was impaired in her ability to drive by her various ailments and by certain medications prescribed to her, as a result of which she drove her car into the front of a hospital killing the decedent, a doctor, the issue presented is whether the case must in the first instance be submitted to a medical tribunal pursuant to G. L. c. 231, § 60B.



Interested parties may file their briefs in the Office of the Clerk for the Commonwealth, John Adams Courthouse, Suite 1-400, Pemberton Square, Boston MA 02108-1724 (Telephone 617-557-1020). Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
