Lowell School Committee v. Phanna Kem Robishaw
Whether an arbitrator exceeded his authority in ordering reinstated a first-grade teacher who had been dismissed for her inability to speak English fluently; whether a Superior Court judge erred in setting aside the arbitrator's award, ruling that the result was contrary to the law, namely 603 Code Mass. Regs. § 14.05(3), and contrary to public policy as set forth in G. L. c. 71A, § 1.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
