Commonwealth v. Life Care Centers of America, Inc.

In this reported case, the issue presented is whether a corporation may be prosecuted for involuntary manslaughter under G. L. c. 265, §  13, or neglect of a resident of a long-term care facility under G. L. c. 265, § 38 (repealed by St. 2004, c. 501, § 9), based on a theory of collective knowledge and conduct of several of its employees, without an allegation that any specific individual committed acts or omissions amounting to the commission of a crime.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
