Whether a Superior Court judge properly accorded substantial deference to a "guideline" published by the Massachusetts Commission Against Discrimination that requires an employer to provide written notice to a female employee who is absent from work by reason of childbirth if the employer does not plan to guarantee maternity leave benefits beyond the eight weeks specified in the Massachusetts Maternity Leave Act, G. L. c. 149, § 105D.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
