Jose Bejarano v. Alisa Goldberg & others; Controlled Risk Insurance Company & another, interveners

Whether the trial judge properly denied a post-judgment motion to intervene, filed by a medical malpractice insurer for the purpose of prosecuting the defendants' post-trial motions for judgment notwithstanding the verdict or for remittitur; whether the trial judge correctly refused to enter a default judgment against one defendant, allowing a cross-motion for the reason that service of process was insufficient.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
