Commonwealth v. Delanie Humphries
The defendant was convicted of possession of a firearm without a license, possession of ammunition without an FID card, and possession of a loaded firearm without a license based on his role as a joint venturer in an armed assault committed by another person, untried, who possessed both firearm and ammunition at issue. The issue presented is whether Federal due process principles are violated if the unarmed defendant is required to bear the burden of producing evidence that the armed joint venturer was lawfully armed.

Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
