Commonwealth v. Kevin B. Hernon
In circumstances in which the defendant was cited for operating a motor vehicle with a suspended license on February 22, 2012, and the citation was filed in the District Court on March 2, 2012, seven business days later, whether the criminal complaint that issued must be dismissed for failure to comply with the requirement of G. L. c. 90C, § 2 that the citation is to be filed "not later than the sixth business day after the issuance of the citation."
Interested parties may file their briefs in the Office of the Clerk for the Commonwealth, John Adams Courthouse, Suite 1-400, Pemberton Square, Boston MA 02108-1724 (Telephone 617-557-1020). Parties filing amicus briefs are expected to comply with the requirements of Rules 17, 19 and 20 of Mass. Rules of Appellate Procedure. Amicus briefs, to assist the court, should focus on the ramifications of a decision and not solely on the interests of the parties filing such briefs.
